MindMapVault Terms of Service

These Terms of Service govern access to and use of MindMapVault.

By creating an account, using the hosted service, or using related website functionality where these terms apply, the user agrees to these terms.

1. Service summary

MindMapVault is a privacy-focused mind-mapping service with hosted cloud features and local/desktop workflows.

The service is designed around client-side encryption. The goal is that readable mind map content and decryption keys do not need to be available to the server in normal operation.

2. Eligibility and account responsibility

Users must only use the service if they are legally able to enter into a binding agreement under applicable law.

Users are responsible for:

• keeping account credentials secure;
• keeping devices and email accounts reasonably secure;
• activities performed through their account;
• choosing whether to provide optional profile or contact information.

3. Encryption and recovery limits

MindMapVault is designed so that the operator should not have ordinary access to readable mind map contents.

Because of that design:

• users are responsible for keeping their passwords and recovery-relevant secrets safe;
• if a user loses the credentials needed to decrypt their data, recovery may be impossible;
• the service does not promise magical server-side recovery that would break the stated encryption model.

4. Acceptable use

Users must not use the service to:

• break the law;
• abuse, interfere with, or disrupt the service;
• attempt unauthorized access to systems, accounts, or data;
• upload malware or harmful code;
• use bots or automation in a way that causes abuse, overload, or evasion of service protections;
• infringe the rights of others.

The operator may apply reasonable technical protections, including anti-abuse checks, rate limits, and account restrictions where necessary.

5. Hosted storage and service limits

Hosted plans may include storage, usage, or feature limits.

These may vary by plan, including free and paid tiers. If a user exceeds plan limits, MindMapVault may limit new uploads, require an upgrade, or require the user to reduce usage.

The exact product limits displayed in the app or website are part of the operational service offering and may be updated over time.

6. Paid plans and billing

If paid plans are offered:

• billing is handled through the configured payment processor;
• pricing, billing periods, and plan limits are described on the service or checkout surfaces;
• users authorize charges consistent with the selected plan;
• taxes may apply where required;
• refunds, if any, are handled according to the policy presented at purchase or applicable mandatory law.

MindMapVault may change pricing or paid plan structure prospectively with reasonable notice.

7. Feedback, support, newsletter, and blog

If users send feedback or support messages, MindMapVault may use that information to operate, improve, and support the service.

MindMapVault may later add:

• a newsletter;
• a blog or product updates area on the marketing site.

If a newsletter is introduced, the intent is that it will be opt-in and provide an unsubscribe mechanism.

8. Availability and changes

MindMapVault is a live software service and may change over time.

The operator may:

• add, remove, or modify features;
• change infrastructure providers;
• perform maintenance;
• suspend parts of the service for security or operational reasons.

Reasonable efforts may be made to keep the service available, but uninterrupted availability is not guaranteed.

9. Suspension and termination

MindMapVault may suspend or terminate access where reasonably necessary, for example if:

• these terms are violated;
• the service is being abused;
• legal compliance requires action;
• security risks require urgent intervention.

Users may stop using the service at any time.

Account deletion and data deletion behavior are subject to the actual product flows, backup cycles, legal retention duties, and security requirements.

10. Intellectual property

MindMapVault and its software, branding, website content, and related materials remain the property of their respective owners, except for user-provided content.

Users retain rights in content they create or upload, subject to the limited rights needed for MindMapVault to operate the service.

11. No sale of user data

MindMapVault does not intend to sell user personal data.

Operational use of processors and infrastructure providers does not count as a sale of user data for this purpose.

12. Warranties and disclaimers

To the maximum extent allowed by law, the service is provided on an "as is" and "as available" basis.

MindMapVault does not guarantee that:

• the service will be uninterrupted or error-free;
• every bug will be corrected immediately;
• every user device, browser, or environment will behave identically.

Nothing in these terms removes rights that cannot legally be excluded under applicable consumer law.

13. Limitation of liability

To the maximum extent permitted by law, MindMapVault will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Where liability cannot be excluded, it should be limited to the minimum extent permitted by law.

If paid services apply, a more precise liability cap may later be added once the final business/legal structure is settled.

14. Governing law and jurisdiction

This section should be finalized once the formal operating entity and jurisdiction are fixed.

Until then, the intent is that the terms be interpreted under the law applicable to the operator’s principal establishment, subject to mandatory consumer protection rules that apply to the user.
